Under Constitutional Claim N276 of the Georgian citizen Ketevan Bakhtadze: (1) Article 30, paragraph 1 of the said law with respect to Article 42, paragraph 1 of the Constitution of Georgia, Article 74, paragraph 2 and Article 75, paragraph 1 with respect to Article 42, paragraph 1 of the Constitution of Georgia and (2) Article 46, paragraph 2 of the Organic Law of Georgia on Courts of General Jurisdiction of 13 June 1997 with respect to Article 29, paragraph 1 of the Constitution of Georgia under which it is inadmissible to designate as a judge a person who was released from the position of the judge based on the ground specified in Article 54, paragraph 1, sub-paragraph “c”.
